Terms and conditions

Please read these conditions carefully as they, together with the specific information about your confirmed transfer, form the basis of your contract with us detailed on your confirmation email.

Any references to 'we', 'us' or 'our' refer to NerjaTourism. Any references to "you" and "your" and ‘passenger(s)’ include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is transferred.

Contract

NerjaTourism acts as a booking agent for transportation service providers (‘the services’). The contract for the provision of the services is between you and the service provider. When requests are submitted for a service, your reservation details are sent to the service provider and only when the service provider accepts your reservation and the booking is paid for by you, a confirmation email is sent to you and then a contract is formed between you and the service provider. No contract will exist until all monies have been received by us in full. Where a booking is made by telephone, the booking is subject to, and the client accepts, our Terms and Conditions.

We, on behalf of our suppliers, are entitled to refuse any booking made by you and we can not guarantee to successfully book a supplier to every booking request. If we are unable to confirm your booking we will inform you by email or telephone.

Changes and Cancellations

If you need to amend or cancel your booking details, you should do so online or by emailing us, at info@nerjatourism.com or calling 020 3129 3424.

All cancellations received with 72 hours notice or less will incur a 100% cancellation charges.

Amendments can be made directly to us at, info@nerjatourism.com at least 72 hours before your transfer date within UK office hours only.

For booking amendments, we cannot guarantee that all changes will be possible, due to matters such as availability, but we will always attempt to secure your requirement for you.

Refund policy

There will be no cancellation charge if a cancellation is communicated to us 72 hours prior to the first transfer and you will receive a full refund. All cancellations received with 72 hours notice or less will incur a 100% cancellation charge.

Behaviour

Our suppliers reserve the right to refuse to carry any person who is thought to be under the influence of alcohol or drugs and/or whose behaviour is considered to pose a threat to the driver, the vehicle or the other passenger(s).

Passengers are not allowed to take onto vehicles any alcoholic drinks or drugs for the purpose of consuming them in vehicles.

Smoking is not permitted in vehicles.

In the event of any passenger being asked to leave a vehicle, we will not be liable for the refund of any journey in this circumstance.

Child Seat Installation

It remains the lead passenger´s full responsibility to ensure the seats are anchored correctly and the straps are properly locked and adjusted.

Insurance and Liability

We select Suppliers of transfer services using reasonable skill and care. We have no liability to you for the actual provision of the services.

We and each of our group companies, officers and employees, exclude all liability and responsibility for any amount or kind of loss or damage that you may incur including any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, or loss or damages arising from or connected in any to business interruption whether in tort, contract or otherwise, even if foreseeable, in connection with your booking.

Our liability to each passenger shall be no more than the cost of getting to the requested destination by taxi and is limited to the cost of the passenger’s booking for the services.

We or the supplier will not incur any liability whatsoever in the event of any delay due to causes beyond our control. The following are examples of circumstances which are not within our control: accidents causing delays to the vehicle, vehicle breakdown, restricted vehicular access, exceptional or adverse weather conditions, compliance with requests of the police, vandalism and terrorism, unforeseen traffic delays, industrial action by third parties, problems caused by other clients, the vehicle being held or delayed by a police officer or government official, other circumstances affecting passenger safety.

Where, the client has failed to provide complete and correct information, we or the service provider shall have no liability in the operation of any service provided.

Travel Insurance

We strongly advise you to arrange appropriate travel insurance and ‘supplier failure’ insurance to cover you for a comprehensive range of events. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

Law and Jurisdiction

These terms and conditions are governed by Spanish law and the courts of Spain have exclusive jurisdiction over any dispute or claim arising out of it.
